There is a $5.00 processing fee added on to all online signups. If you do not wish to pay this fee, please signup at the Tuesday meeting.

Instructions:

1. All online payments are processed via PayPal and are made payable to "Fun & Sun Water Ski Club"

2. We must have the Release, Waiver, and Indemnity Agreement signed and on file by the 8:00 PM Tuesday signup meeting in order to participate in the event. All required fees are also due at that time. ALL ONLINE SIGNUPS MUST BE COMPLETED BY 11:00 PM ON MONDAY PRIOR TO THE SIGN-UP MEETING.

3. Cancellation Policy: No refunds. Credit will be issued towards another event in the same calendar year, if the Boat Commodore is contacted by noon Thursday prior to the event.

4. Sign-up for a duty - Volunteer: The Club relies on members to perform small tasks to make the outings successful. Those who do not sign up for duties are the first to be bumped from an outing if space is limited.

   • You will be notified by email after the Tuesday signups to the duty you have been assigned.

   • Your selection does NOT guarantee you will be assigned that particular duty.

   • The trip chair has all final say on all duty assignments, though we will make every effort to assign you your requested duty.

5. Equipment: The Club has skis, wakeboards, and vests, which you may borrow for the outing. Should the equipment be lost, you will be charged for the replacement cost.

6. Bring whatever essentials you require. Gloves, lotion, towels, etc. DO NOT ask the boat owner to borrow their belongings.

Fees: All online transactions will be charged an additional $5.00 processing fee.

RELEASE, WAIVER, AND INDEMNITY AGREEMENT

In consideration of being allowed to participate in any and all events and activities, I HEREBY AGREE AS FOLLOWS:

FUN & SUN WATER SKI CLUB ('the club') is dedicated to the enjoyment of waters sports. The Club furnishes water ski equipment and organizes activities for members. All Club officers (elected and appointed) volunteer their time.  If the Club were required to maintain a comprehensive general liability insurance policy (to cover officers, members, boats and Club equipment),  it could not offer membership at such a low fee. Therefore, prospective members are on notice that the club does not maintain an insurance policy and they are responsible to ensure they are individually covered by their own insurance policies.

FROM THIS DATE FORWARD, I HEREBY ASSUME ALL RISKS INVOLVED IN MY PARTICIPATION IN ALL FUN & SUN WATER SKI CLUB EVENTS AND ACTIVITIES.

I ALSO RECOGNIZE THAT WATER SPORTS AND SNOW SPORTS ARE INHERENTLY DANGEROUS SPORTS, IN WHICH ACCIDENTAL INJURY AND ACCIDENTAL DEATH MAY OCCUR.

I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Club member's, it's officers, participants, promoters, sanctioning organizations or any subdivision thereof, owners and leasees of the premises used to conduct said events, and each of them, all for representatives, assignees, heirs, and next of kin for any and all loss or damage on account of injury to person (including death) or property.

I HEREBY AGREE TO INDEMNIFY, SAVE, AND HOLD HARMLESS the releasees, and each of them, from any loss, liability, damage or cost they may incur due to the presence of the undersigned in any way while participating in any event and whether caused by the negligence of releasees or otherwise for losses, damages (including attorney fees) which may be brought against me or against any of them by anyone claiming to be injured (including death) as a result of any injury caused by me or injury to my or the claimant's property which may occur as a result of my participation.

I EXPRESSLY AGREE that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by law in the State/Province in which the event is conducted and that if any portion thereof is held invalid it is agreed that the balance shall continue in full force and effect. I further expressly agree to indemnify and hold harmless the Club's use of images of me, in photographic or video form, for promotional purposes or any other type of publication.

I also understand that the boat owner and boat driver are responsible for knowing the boating laws of any waterway that he/she uses. It is my responsibility to obtain and read the following:

(1) The ABC's of the California Boating Law (booklet) available from the California Department of Motor Vehicles (DMV) and the California Department of Boating and Waterways http://dbw.ca.gov

(2) Lake McClure - Lake McSwain Recreation Area - Mariposa County Ordinance booklet. This booklet can be obtained from the Merced Irrigation District (M.I.D.) Park Ranger upon entering the Lake McClure park.

I HAVE READ AND VOLUNTARILY SIGN THIS RELEASE, WAIVER, and INDEMNITY AGREEMENT and further agree no oral representation or inducements apart from the foregoing have been made.

I HAVE READ THIS RELEASE, AND I UNDERSTAND THAT PRIOR TO SIGNING THIS AGREEMENT, IF I HAVE NOT UNDERSTOOD THIS RELEASE, IT IS MY RESPONSIBILITY TO OBTAIN A CLARIFICATION FROM LEGAL COUNSEL AT MY EXPENSE.   

BY SIGNING BELOW, I HEREBY AGREE WITH THE ABOVE STATEMENTS AND RECOGNIZE THIS WAIVER TO COVER ALL CLUB SPONSORED EVENTS FOR THE CURRENT YEAR.
